Ngbuka does not guarantee any specific number of sales or service bookings. The success of your business on the platform is dependent on various factors, including but not limited to, the quality of your products or services, pricing, market demand, and customer reviews.
While we strive to ensure the platform is available at all times, we do not guarantee that the services will be uninterrupted, timely, secure, as a result of system update or malfunction. The platform may be unavailable from time to time due to maintenance, updates, or technical issues. If the agreement cannot be performed due to force majeure, the responsibility shall be exempted in part or in whole according to the influence of force majeure.
You are solely responsible for the accuracy of the information provided in your product listings and service descriptions. Ngbuka does not guarantee the products you upload and is not liable for any inaccuracies, misrepresentations, omissions or claims that may arise from our users and clients.
Ngbuka does not endorse, verify, or guarantee the quality, safety, or legality of the products and services offered by sellers and mechanics. You are responsible for the quality control of your products and services. You also pledge to comply with all applicable laws, regulations, and safety standards.
You are liable for all transactions and interactions with customers on our platform. Ngbuka is not liable for any disputes, claims, losses, or damages arising from your dealings with customers. This includes, but is not limited to, issues related to payment, delivery, returns, warranties, and customer assurances.
You are responsible for the products you sell and the services you offer do not infringe on any third party’s intellectual property rights. Ngbuka is not liable for any intellectual property disputes or claims arising from your listings or services. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal and non-commercial use.
You must comply with all extant laws and regulations in force in the Federal Republic of Nigeria as it relates to your business operations on Ngbuka. This includes, but is not limited to, tax obligations, business licenses, and consumer protection laws. Ngbuka is not responsible for your compliance with such laws and regulations and shall not be held liable for non-compliance.
To the fullest extent permitted by law, Ngbuka, its affiliates, and their respective officers, directors, employees, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the platform; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the platform; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our platform by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the platform.
You agree to indemnify Ngbuka, its affiliates, and their respective officers, directors, employees, agents, and representatives from any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the platform, your violation of this Disclaimer, or your infringement of any intellectual property or other rights of any person or entity.
